Key Provisions of the Immigration Bill and Foreigners Law
The Immigration and Foreigners Bill, 2025, considered a comprehensive overhaul of the existing immigration framework in India. It introduces several new provisions aimed at tightening border security and regulating the stay of foreign nationals in the country. Here are the main highlights:
1. Stricter Penalties for Illegal Entry
Foreign nationals who enter India illegally or use forged travel documents will now face up to 5 years of imprisonment and fines up to ₹10 lakh. This is a significant step toward curbing unauthorized immigration.
2. Mandatory Reporting by Institutions
Educational institutions, healthcare centers, and other service providers will legally obligated to report the presence and details of foreign nationals using their services to concerned government departments.
3. Transporter Accountability
Airlines, shipping companies, and other travel facilitators must now ensure that all foreign passengers carry valid documents. Failure to do so may result in a fine of up to ₹5 lakh.
4. Broader Governmental Control
The law also empowers the central government to exercise stronger control over who enters and remains in India. The government may bar entry or deport individuals if it deems it necessary for national security, public order, or health concerns.
What This Means for the Future of Immigration Policy
With the new Immigration and Foreigners Law in place, India has taken a firm stance on border control and internal security. The move expected to impact visa regulations, immigration processing, and oversight of foreign nationals in various sectors across the country.
The government sees this as a much-needed update in a rapidly globalizing world, ensuring that immigration policies align with national interests and global best practices.
